Martin Amidu Files Petition to Remove Special Prosecutor Kissi Agyebeng From Office

President Nana Akufo-Addo on May 6, 2024, submitted the petition to the Chief Justice for consideration.

A petition has been submitted to President Akufo-Addo to consider the removal of the Special Prosecutor, Kissi Agyebeng, from office.

According to reports, the petition dated April 30, 2024, was filed by Mr. Agyebeng’s predecessor, Martin Amidu, who has previously criticized the current Special Prosecutor for a lack of “experience” in the job. Relentless times, Mr. Amidu has accused Agyebeng of shielding certain persons under the OSP’s investigative radar, particularly regarding the case of investigative journalist Anas Aremeyaw Anas (who was once Agyebeng’s client) and Charles Bissue, a former political appointee.

The petition alleges Kissi Agyebeng breached procurement rules in the purchase of vehicles for the Office of the Special Prosecutor (OSP) and abuses involving judges and the administration of justice.

Other allegations by the petitioner against Agyebeng include violations of citizens’ rights through arrests and detentions, violations of the right to information, and improper appointments of personnel to the office.

Examples are made of the arrests of former Sanitation Minister Cecilia Dapaah and former Environment Minister Prof. Frimpong Boateng.

The call for the OSP’s removal is made under section 15 of the Office of Special Prosecutor Act, 2017 (Act 959), which states the grounds and processes for the removal of a Special Prosecutor.
